Editor’s Note: Tim Miller, president of Lionshead Specialty Tire Wheel LLC, continues to battle against the Section 301 tariff which would mandate a tax on specialty trailer aluminum wheels, steel wheels and tires. Below is a letter to clients updating them on status for the proposed tariff.

I wanted to keep you updated on our efforts in the fight against the Section 301 tariff and make sure you’re aware of an anti-dumping tariff that is being pursued against trailer wheels. 

Regarding the Section 301 tariffs, I presented our testimony to the panel at the International Trade Commission building. The panel included representatives from the Office of the U.S. Trade Representative (USTR), the Department of Homeland Security, the Department of Commerce, USDA and the Small Business Administration. 

The administration has requested either a 10% or 25% tariff on all specialty trailer tires, specialty trailer aluminum wheels and specialty vehicle steel wheels. In our testimony we highlighted that:

  • Our products do not contain industrially significant technology.
  • There are no other alternate manufacturers with the required size and scale for these products outside of China.
  • By adding a tariff to these products there will be undue economic harm caused to industries that we serve and their customers. 

The panel will review all information and then make the final determination as to which products will be subject to this tariff. Based on the previous Section 301 tariff rulings we expect this to be announced in the latter half of September.

We are also fighting against the specialty trailer steel wheel Anti-Dumping tariff that Dexstar has submitted. Dexstar is part of the Kenda/Americana corporation and they have petitioned the U.S. Department of Commerce for a 50% Anti-Dumping tariff on ST steel wheels.

For the Kenda tariff I will be an expert witness against the tariff and will be giving my testimony on Wednesday (Aug. 29). It is expected to take a number of months for the final determination of this petition.

I know it is unique for a company like ours to get fully engaged in anti-tariff initiatives. However, it is our experience that once a tariff is applied it is very unlikely to be reversed. So the time to fight against these actions is now. 

We will continue to keep you updated on the status of these tariffs. These are critical issues for all of us and we want to make every effort to ensure that our clients are kept up to date.
